The mayor of Faro, which today revealed, in a five-point communiqué, that it had already been "acquainted with the clarification" that it requested to the Constitutional Court, does not disclose the content of the clarification and states that it will remain in office, "waiting for the full clarification of this strange case."

Macário Correia adds that "because there is a clear divergence between what was exposed in the different phases of the process and the decision communicated, among other facts, the appropriate procedures will be brought within the legal deadline", without saying, however, which procedures will be those.

Therefore, in his opinion, "it continues obviously to seem unconstitutional that any person can be convicted, without first being shown that they committed any illegality."

For this reason, Macário decided to remain in the position and added that «considering this information [his communiqué] clear and sufficient, I will not provide, for the time being, any additional public statement».

Macário Correia was sentenced to lose his mandate by the Supreme Administrative Court, for violation of the mechanisms of territorial planning, in a decision confirmed by the Constitutional Court, after dismissing an appeal presented by the mayor, a decision that was made public in January.

Em press conference last January 25th, the PSD mayor announced that he had asked for clarification of the ruling of the Constitutional Court, which determined his loss of mandate, thus seeking to gain time.

José Macário Correia had been convicted, in June 2012, by the Supreme Administrative Court, the loss of office due to violation of urban planning and land use regulations when he was the mayor of Tavira. The mayor then appealed to the Constitutional Court, which confirmed the loss of mandate.

The Farense mayor had been accused “of guilty violation of valid and effective instruments of management and planning of the territory or urban planning”, in a case in which he had been acquitted in the first instance.

The case has to do with 21 processes for licensing housing, swimming pools and rural tourism, always violating the Protal and the PDM of Tavira. The STA considered that "the various illegalities thus committed" by the mayor "correspond to the most serious form of violation of the current urban legal framework".

Macário Correia was elected president of the Tavira City Council in 1998, where he remained until 2009, the year he won the Municipalities in Faro.
