Report decrees effective sentence for man who tried to kill outside a bar in Olhão

Case dates back to November 2021

A man who tried to kill another with half a pair of scissors, in November 2021, in Olhão, saw an effective prison sentence handed down to him by the Court of Appeal of Évora, following an appeal imposed by the Prosecutor of the Republic of the Central Criminal Court of Faro to the suspended sentence that was ordered in the first instance.

In a first trial, the man, a 27-year-old barber, saw "a single sentence of 5 years in prison, suspended upon execution, imposed on him for a crime of attempted murder and a crime of threat."

Following the appeal, the defendant was sentenced to a single effective sentence of 6 years and 2 months in prison.

According to the Public Prosecutor's Office, on November 6, 2021, at 23 pm, after drinking "medronho brandy and beers", the defendant left a bar in Olhão and fell to the floor.

The victim, “who knew the defendant, went over to him and helped him to sit down”, having turned his back on the attacker after doing so.

«The defendant got up, took out a bag that contained half of a barber's scissors, went to the victim and with the scissors, at the same time saying “I'm going to kill you”, “I'm going to make you look bad” », he struck him twice in the neck and two blows in the back, «in the shoulder blade region», described the MP.

In the sentence it handed down, which was aggravated in relation to that of the first instance, the Court of Appeal of Évora “gave special emphasis to the fact that the defendant struck the blows after the victim had helped him to get up from the ground; the fact that he already carried the murder weapon with him; the energy put into carrying out the action and its consequences”.
