Municipalities start to “manage” public parking, including fines for minor infractions

Parking inspection, as well as instruction and decision of road administrative infraction procedures for light infractions are under the authority of the local authorities

The Council of Ministers approved today the decree-law that implements the transfer of competences to municipal bodies in the domain of public parking, including administrative offenses for light infractions in the road network dependent on the municipalities.

Municipalities thus begin to exercise competences with regard to "parking inspection, as well as the instruction and decision of road administrative offense procedures for light infractions on lanes or sections of lane under concession or sub-concession within localities and outside localities under municipal jurisdiction". clarifies the statement of the Council of Ministers.

This diploma joins the other 15 already approved in the scope of the transfer of competences to local authorities and to inter-municipal entities, provided for in the Framework Law on Decentralization, published on 16 August.

Until now, the diplomas referring to the transfer of competences in the areas of proximity policing, games of chance, European funds and investment attraction, tourism promotion, beaches, justice and firefighters associations.

Diplomas relating to the civil protection, animal protection and health and food safety, housing, service structures to the citizen, ways of communication, management of public real estate, culture and social action.

Taking into account that the approximately two dozen sectorial decentralization diplomas must be approved by the Council of Ministers by October 15th, because of the State Budget, it is still necessary to approve documents in more sensitive areas, namely health and education, as well. such as those referring to port areas, river transport and parishes.

In the Algarve, there are municipalities with doubts about the acceptance of the transfer of competences, while the Silves City Council and Municipal Assembly, with a CDU majority, have already rejected joining this process.
