Covid-19: Failure to comply with beach rules entitles to fines

There may be fines between 50 and 100 euros

Failure to comply with the rules relating to access and occupation of beaches, within the scope of the Covid-19 pandemic, will this year be subject to an administrative infraction, confirmed today the Minister of the Presidency.

In a press conference after the weekly meeting of the Council of Ministers, Mariana Vieira da Silva explained that this regime did not apply in 2020 because when the decree-law on beaches was approved, there was still no planned administrative offense.

“This was approved after the approval of the beach decree law. Therefore, this administrative offense regime, which is provided for non-compliance with a set of rules that we have in the Covid area, is also applied” to the rules relating to beaches, he clarified, adding that inspection will be the responsibility of the Maritime Police.

Jornal de Notícias reported today, citing "the draft decree-law approved by the Council of Ministers on May 6", that there will be fines of between 50 and 100 euros for those who do not wear a mask when accessing beaches, restaurants, spas and cliffs, as well as for those who are visiting an overcrowded beach.

The JN also said that the concessionaires will also be the target of heavier administrative offenses, with fines ranging from 500 to 1.000 euros, if they fail to sanitize and clean their equipment or do not post the standards for bathers in a visible place.

During the press conference, Mariana Vieira da Silva reiterated what she had already said last week regarding places where it is or is not mandatory to wear a mask.

“Like last year, it is not necessary to wear a mask on the beach and it is necessary to wear a mask on access to the beach, access to cafes and restaurants, restaurants and bathrooms. These are the same rules that were in force a year ago,” he said.

One of the changes compared to last year, added the Minister of the Presidency, is related to the system of traffic lights at the entrance of the beaches, related to their occupation.

According to Mariana Vieira da Silva, the green color now indicates an occupation of up to 50%, the yellow color between 50% and 90% and the red color above 90%.

In 2020, the color green indicated low occupancy (1/3), yellow high occupancy (2/3) and red full occupancy (3/3).
