The mayor of Faro, in clarification about the news of your sentence to loss of mandate by the Supreme Administrative Court released this morning, reiterates that it has already submitted "the competent appeal, in view of the total contradiction existing on the same matters, in three different courts».

«Waiting for the clarification of the aforementioned contradictions, I continue in the normal performance of the functions for which I was elected, in total dedication to the populations I swore to serve», says Macário Correia in his clarification of 10 points.

The PSD mayor begins by recalling that, "in 2008, an ordinary inspection was carried out in the Municipality of Tavira, in the domains of urbanism and works relating to the previous four years."

At the end of this inspection, Macário says he collected "globally positive words from the inspectors regarding the assessment made to the analyzed processes and the general functioning of this City Council".

However, he adds, "in 2009 I learned that there was a change of direction, by superior orders, and that the report would include a report to the Public Prosecutor's Office regarding small cases of private works."

Two years later, he continues, "the Administrative and Fiscal Court of Loulé ruled the accusation completely groundless, confirmed the legality of the acts carried out and refused the requested loss of mandate."

But “the Public Prosecutor's Office appealed to the Central Administrative Court, which again considered the acts in question as legal and fully confirmed the previous decision of the aforementioned Court of Loulé”.

However, “the Public Prosecutor's Office has appealed again, and the Supreme Administrative Court issued a decision contrary to the two previous courts a few days ago. The competent appeal has already been filed against this decision, in view of the total contradiction existing on the same matters, in three different courts».

In his clarification, Macário Correia also says that, "of the processes of private works in question, four were individually assessed by the Court of Loulé, considering two of them perfectly legal and the other two not, and the Municipality of Tavira appealed against this in light of the contradiction with the decision taken on these same cases in another judicial process».

Therefore, he clarifies, "so far, none of the cases mentioned in the decision of the STA has been subject to a final and unappealable declaration of illegality". Thus, concludes the mayor, "it does not seem normal that someone can be condemned for acts of little significance, which were not even considered definitively illegal."

The conviction of Macário Correia, by the Supreme Administrative Court (STA), which determines the loss of his current term at the head of the municipality of Faro, was known this Tuesday, but the ruling dates back to June 20th.

The case is related to several licensing processes, when Macário Correia was still president of the Tavira Chamber, and in which he allegedly violated the Protal and the PDM.

According to the STA, the Algarvian mayor acted "with a high degree of guilt, when practicing the unlawful facts mentioned", which makes him "incur in the loss of office".

However, just last night the president of the PS Council of Faro challenged the PSD/CDS coalition, through which Macário Correia was elected as president of the Chamber of Faro, to assess "if there are conditions" to remain at the head of the municipality of the Algarve capital.
