The Provisional Provision for suspending the introduction of tolls on Via do Infante has already been handed over to the Loulé Administrative Court. The lawsuit was filed today, Friday, by the Algarve Anti-Toll Movement, but there is no guarantee that the tolls will not start being collected on December 8, even if the court agrees with the plaintiffs.

It all depends on whether or not the court accepts the request for a provisional decree preventing toll collection, while the main action is not evaluated. The motion made a request to that effect, but the court may find there is no reason to approve it.

According to the lawyer responsible for the lawsuit João Caetano, for the precautionary measures, the law provides that, under normal conditions, the court has "ten days to hear the counter-interested parties and another five days to issue a decision."

An explanation given this afternoon, in Loulé, during the Press Conference scheduled by the anti-toll movement, to announce what measures it will take following the approval of the decree-law that determines the introduction of tolls on the Scut do Algarve motorways, from Beira Interior, North Interior and Beira Litoral/Beira Alta.

João Caetano added that the injunction is based on 3 main grounds, the first of which is «the wrong classification of Via do Infante as Scut highway», since the financing model used to build the road, in 70 percent of its length , «it was not the same as the other Scut».

«The Infante Road, to the Alcantarilha node, was built with ERDF funds, through the State budget», he explained.

Another argument put forward against the introduction was "the serious social and economic consequences" that the movement believes the measure will cause.

The anti-toll movement also alleged, in the lawsuit, the "lack of legitimacy" of the Government to decide on the matter without being "armed with the authorization of the parliament", which constitutes, they argue, "an unconstitutionality".

Another measure that is already scheduled by the movement is the realization, on December 7, «of an action that intends to symbolize the burial of the economic and social development of the Algarve», whose contours are not yet fully defined, according to movement member João Vasconcelos.

The initiative will also serve "to point the finger at those responsible outside and within the region." João Vasconcelos appointed deputies Mendes Bota and Miguel Freitas, of the PSD and PS, respectively, for not having tried to stop the measure.

Even if it is not possible to stop the introduction of tolls through the courts, members of the movement guarantee that they will not lower their arms and will continue to fight “until the measure is suspended”.

Thus, "other actions, such as slow marches", were promised, the first of which should take place "already this month or, if this is not possible, in January".

The Algarve Anti-Toll Movement is formed by the Commission of Users of Via do Infante, by the Algarve Movement – ​​«Tolls on the A22 Não!», born on Facebook, by Motoclube de Faro and by the Movement «With Faro in the heart".
