Câmara de Olhão takes possession of the Hotel Ria Sol to carry out a «security intervention»

The City Council of Olhão took administrative possession of the building of the former Ria Sol Hotel to carry out works to ensure the health and safety of this building, located on the corner between Rua 18 de Junho and Rua General Humberto Delgado, a few meters from the headquarters of the Parish Council of Olhão.

Contacted by Sul Informação, António Pina, mayor of Olhão, said that the building “will be the target of a security intervention”, taking into account its “high state of degradation and abandonment”.

The intervention will be made at the expense of the Chamber, but "the bill will be sent to the owner of the building", who has already been notified to carry out the works for years.

"After an inspection carried out in 2017, the municipality considered that the building needed works that would immediately prevent material and personal damage on the public road, as well as its use by outsiders", revealed the City Council of Olhão, in a press release .

As a result of this inspection, "the owner was notified of this decision, but never carried out the respective works, which, over time, increased the state of degradation of the property".

"As the owner has not proceeded to clean the materials and waste, as well as to close the openings of the doors and windows that are opened, the municipality resorted to administrative swearing in, and the respective coercive works have been underway since this morning, that run on behalf of the offender», added the municipality.

 

 

António Pina clarifies that, for the time being, «the forced sale of the property is not in question» and that the intervention of the City Council will only serve to «guarantee security».

The works that the City Council will carry out "go through the closing of the doors and windows", bearing in mind that this is a place "inappropriately used by some people, namely drug addicts", in addition to representing a danger to public health , because of «being full of garbage and animals».

The action of the municipality of Olhão is framed in the Legal Regime of Urbanization and Building, which "entrusts the competent administrative bodies, in this case, the City Council, to adopt appropriate measures to determine the execution of conservation or demolition works, whenever the buildings present poor safety or health conditions and a danger to public health, and whenever their owners do not take the necessary measures».

"For this action to materialize, it is necessary to resort to the figure of administrative possession, which allows the President of the Chamber to determine the ownership of the property, in order to allow the coercive execution of measures necessary to restore legality."

This does not mean that the owner loses ownership of the property. However, the law stipulates that all expenses that the municipality incurs in the process will be charged to the owner of the building.

What is certain is that this is an emergency operation, very focused on health and public health. But there is also the issue of the vacant building, in a central area of ​​the city, which the municipality does not intend to neglect.

"The Chamber is going to create another urban rehabilitation zone - we already have two, this will be the third -, which will include this building, with a view to, later - and then yes - evolve into forced sale", he assured the Sul Informação Antonio Pina.
