top tavira hutsThe Chamber of Tavira promotes today, Saturday, 29 October, a meeting to clarify the recent placement of a fence, by a private person, on a path over the cliff that connects Cabanas de Tavira to the Lacem site, thus preventing passage. The session takes place at 15:00, at the Parish Council of Cabanas de Tavira.

This meeting follows a letter from a townsman, giving voice to the discontent of people who used to use that road for walking. The document is signed by Alexandra do Ó and, from the signatory's point of view, the fence was placed in an area of ​​public maritime domain.

«The top of the aforementioned cliff is part of the public maritime domain, that is, in the 50-meter strip defined from the maximum high tide line of equinoctial living waters (ie, the base of the cliff), according to the provided for by Law No. 54/2005 of 15 November, as well as by the amendments introduced by Law No. 34/2014 of 19 June, and No. 31/2016 of 23 August", explains the letter.

Therefore, this fence came to prevent "the right of access and passage recognized by the public maritime domain", adds Alexandra do Ó.

The document also asks that "administrative easements on private portions of beds and banks of public waters be respected, in accordance with the provisions of paragraph 1 of Article 21 of Law No. 54/2005, which establishes that all private portions of beds or banks of public waters are subject to easements established by law and in particular to a public use easement, in the general interest of access to waters and passage along fishing, navigation and floating waters».

Finally, the Tavira City Council is required to "initiate the necessary steps as soon as possible with a view to restoring the right of way and access over the steep cliff."
