Court accepts 134 injunctions to suspend demolitions of houses in the Farol

island of Farol_cfs_1The Administrative Court of Loulé accepted, this Friday, 134 injunctions filed by owners of houses in the housing nucleus of the Farol, in Ilha da Culatra, in Faro, to prevent the administrative takeover of these houses by the Polis Ria Formosa Society, with a view to their demolition.

This procedure was scheduled for next Monday, April 27th.

According to Feliciano Júlio, representative of the owners who challenged, in court, the progress of the renaturalization of the nascent area of ​​the nucleus of the Farol, all the actions presented, in this first phase, were accepted.

As this is an injunction, the Polis is prevented from taking administrative possession of the houses, a fundamental condition to proceed with the demolitions, and will have to present arguments to the Court within ten working days. Only after that will there be a final decision.

According to the representative of the inhabitants of the Farol, of the 134 injunctions granted today by the court, "97 concern second-dwelling houses and 37 first-dwelling houses."

Then, there are 14 houses for first homes, whose process is being re-evaluated by the Polis Society and, therefore, have not yet received the letters [announcing the administrative takeover]», revealed Feliciano Júlio.

In other words, the joint process (although with individual actions, for each house), which is being handled by the same lawyers, brings together 176 homeowners in that area of ​​Ilha da Culatra. But it does not cover all those who are liable to see their homes go down in the Farol. Altogether, there are around 210 houses here, which means that Polis may take administrative possession of the other 66 houses there, if their owners do not proceed with precautionary measures, which are eventually accepted.

As for the arguments that were used and prevailed at the Court of Loulé, Feliciano Júlio does not reveal them, as the case "is in the secrecy of justice".
