The National Political Commission of the PSD called, for next week, a meeting with Macário Correia and the presidents of the Political Commissions Council – Cristóvão Norte – and District – Luís Gomes -, to analyze the situation created by the loss of mandate of the mayor of Faro.

It is expected that even before this meeting, Macário Correia will release a statement on the process that removed him from the Chamber of the Algarve capital.

“Having been yesterday [Tuesday] known the ruling of the Constitutional Court, Eng. Macário Correia made public his intention to make a statement about his lawsuit in the coming days. We await the aforementioned public statement and, in order to analyze this situation, a meeting with Eng. Macário Correia and with the Presidents of the Municipal and District Political Commissions Faro”, states the PSD communiqué, signed by Jorge Moreira da Silva, Vice President and Permanent Coordinator of the National Political Commission.

However, Macário Correia now has three months to leave the Chamber of Faro. The sentence will be executed by the court of first instance, the Administrative and Fiscal Court of Loulé, which sets the deadline for complying with the sentence and a possible fine for non-compliance.

According to Gonçalo Guerra Tavares, a specialist in Administrative Law, from the CMS-RPA, cited by Jornal de Negócios, at this moment, Macário Correia can no longer complain to any other side.

The expert says that now follows "an execution of a sentence for rendering infringable fact", so that, according to the law, "the condemnatory sentence must be executed by the Administration within a period of three months".

In fact, the decision of the Constitutional Court, dated 10 January, rejected the admissibility of the mayor's appeal for the second time. The first was taken on October 18, 2012: the summary decision rejected Macário's appeal because the mayor was unable to prove which norms there is unconstitutionality, in addition to not having raised this illegality before the STA.

The mayor also complained about this first decision, but now the STA did not agree with him again.

The departure of Macário Correia does not imply mid-term elections for the City Council of Faro, all the more so as there are only six months to the Local Elections. The position will be filled, in principle, by the current vice president, Rogério Bacalhau.
