Amnesty for Pope's visit does not include forgiveness of fines

PS delivered a proposal to amend the amnesty diploma that is being discussed today in the Constitutional Affairs, Rights, Freedoms and Guarantees commission

The Assembly of the Republic votes this Monday, the 17th, in the specialty, the amnesty proposal for people between 16 and 30 years old, regarding the World Youth Day (WYD), which no longer includes administrative offenses of up to one thousand euros, such as fines of traffic.

The PS submitted a proposal to amend the amnesty diploma that is being discussed today in the Committee on Constitutional Affairs, Rights, Freedoms and Guarantees, in which the State ceases, thus, to forfeit the value of fines, as provided for in the original Government document.

The new version, however, contemplates the forgiveness of accessory sanctions related to administrative offenses whose maximum applicable fine limit does not exceed one thousand euros, also granting amnesty to military disciplinary infractions that are not crimes outside the scope of this amnesty proposal and in which the sanction does not go beyond disciplinary suspension or imprisonment.

However, the amendments proposed by the PS do not cover the application restriction for young people up to 30 years old, despite the doubts raised by various entities and specialists about its possible unconstitutionality.

The end of the age limits for applying the amnesty had been proposed by the PSD, while the Liberal Initiative (IL) had defended the absence of age restrictions for offenses punishable with fines of up to one thousand euros.

The PS proposal also included some changes advocated by the PSD, by adding more crimes to the exclusion of amnesty, such as trafficking in human organs, theft, crimes against national sovereignty and the implementation of the rule of law, prisoner riots, corruption in commerce international and in the private sector, against the sporting truth, fraud in obtaining subsidy or subsidy and against children, young people and especially vulnerable victims.

The proposed law already included exceptions to forgiveness and amnesty, not benefiting, namely, those who have committed crimes of homicide, infanticide, domestic violence, mistreatment, offense to serious physical integrity, female genital mutilation, offense to qualified physical integrity, forced marriage, kidnapping, against sexual freedom and self-determination, extortion, discrimination and incitement to hatred and violence, influence peddling, money laundering or corruption.

At issue in the diploma are crimes and infractions committed until June 19 by young people between 16 and 30 years old, to be adopted due to the WYD, determining a one-year pardon for all sentences of up to eight years in prison. An amnesty regime is also foreseen for criminal offenses whose penalty does not exceed one year in prison or 120 days of fine.

The socialists propose that the law enter into force the day after its publication, but to take effect only from September 01, in view of the judicial holidays in the courts.

On this matter, the President of the Republic avoided pronouncing himself at the end of June and reserved a position for later. “I will wait for the position of Parliament. As you know, it has to be a law of the Assembly of the Republic. It is customary in situations like this, of a papal visit, to have amnesties, which have varied a lot. And, therefore, I want to see the final contours of the law and then pronounce myself”, declared Marcelo Rebelo de Sousa.
