The Court of Portimão annulled this Monday, 1 August, the embargo that “Praia da Cova – Realizações Turísticas, SA” placed on 9 May against the work of the Municipality of Silves, at Praia dos Pescadores, in Armação de Pêra, which consists of installing a shelter for the tractor provided by the municipality to the local fishing community.
According to the court, the plot of land on which the work is carried out is part of the public maritime domain and, therefore, “Praia da Cova, SA” (a company linked to the “Vila Vita Parc” group) has no legitimacy to intervene on the land and embargo any work in this portion, reads the note advanced by the Municipality of Silves.
The municipality also advances that, in parallel with this judicial process, another is taking place, also in the Court of Portimão, in which the annulment of a public deed for the purchase and sale of land that would integrate the sand of Praia dos Pescadores de Armação is at stake. de Pêra, celebrated in December 2012, and the recognition that this beach is part of the public maritime domain of the State.
«The Municipality of Silves considers that Praia dos Pescadores de Armação de Pêra, which constitutes the cradle and roots of this fishing village, where the fishing corridor and more than 40 fishing supports for the collection of fishermen's equipment are located, the auction , public baths, the Red Cross post and several commercial establishments and concessions, are part of the public domain of the State», they stress.
After the decision of the Portimão Court, and if there is no appeal, the Municipality says that "the conditions are met for the conclusion of the work on the new tractor shelter in the amount of 95 thousand euros" - an investment framed in the ongoing process that aims to creation of the marine protected area of community interest that focuses on the Armação de Pêra bay, future Marine Natural Park of Recife do Algarve – Pedra do Valado.
«The current permanent municipal executive of the Municipality of Silves, in the face of all these circumstances, will continue to fight for the public nature of Praia dos Pescadores de Armação de Pêra, as part of the public maritime domain of the State, and to ensure the defense of the legality and the pursuit of the public interest, within the scope of the protection of public real estate and the protection of the legitimate rights and interests of the local fishing community”, concludes the note.
