Public Ministry appeals the acquittal of Mariana Fonseca in the murder of Diogo Gonçalves

Crime occurred in March of last year

The Public Prosecutor's Office filed an appeal against the judgment that acquitted Mariana Fonseca, 24, of the crime of aggravated homicide, of Diogo Gonçalves, with the Central Criminal Court of Portimão, the Public Prosecutor's Office of the District of Portimão announced in a statement this Tuesday. Faro.

In the sentence handed down on 27 April, by the Court of Portimão, only Maria Malveiro was sentenced to 25 years in prison for the murder of the 21-year-old, when the prosecution argued that the crime had been committed in co-authorship.

Mariana Fonseca was eventually sentenced to four years in prison, but she was released, as none of the crimes for which she was convicted required preventive detention.

The Public Prosecutor's Office "claims that there was a notorious error in the Court's assessment of the evidence, and that, consequently, the acquitted defendant must be convicted in co-authorship with the other defendant in the crime of aggravated homicide."

The defendants, a nurse and a security guard, were accused by the Public Ministry of the crimes of aggravated homicide, desecration of a corpse, two crimes of illegitimate access, one of computer fraud, simple theft and use of a vehicle.

They were suspected of having killed Diogo, in March of last year, to keep 70 euros that he had received in compensation for the mortal running over of his mother.

The young man's corpse was later dismembered and abandoned in two different and distant locations, the head in Pego do Inferno (Tavira) and the body on a cliff near Cabo de São Vicente. Nearby, the car of the ill-fated young man was also found.
